Compliance in New South Wales: what is different
NSW does not have a state labour hire licensing regime. Victoria has the Labour Hire Authority (VLHA), Queensland has the Labour Hire Licensing Compliance Unit, South Australia operates through Consumer and Business Services, and the ACT requires registration. NSW and WA do not require providers to hold a specific labour hire licence.
That does not mean compliance is optional. The following obligations apply to any Sydney labour hire arrangement.
Fair Work and Modern Awards
The Fair Work Act 2009 and the relevant Modern Award apply regardless of state. Most Sydney warehouse roles fall under the Storage Services and Wholesale Award 2020 or the Road Transport and Distribution Award 2020. The agency is the employer of record and holds the workers compensation policy with icare NSW. Premium is built into the charge-out rate. In a claim, the agency lodges with icare and manages return to work, while the host business provides the incident site information and modified duties where possible.
Work health and safety (shared duty)
Under the Work Health and Safety Act 2011 (NSW), both the agency and the host are persons conducting a business or undertaking (PCBU). The duty of care is shared and cannot be transferred by contract. In practice that means the host owns the safe site, induction, PPE, and supervision, while the agency owns worker selection, capability checks, and HR.
Right to work and documentation
The agency verifies right-to-work at source (passport, visa status through VEVO, Australian citizenship or residency). The host is entitled to sight the documentation before a worker steps on site.
Common warehouse roles we fill in Sydney
Pickers and packers
Manual picking to a pick-ticket, RF scanner, or voice-pick system. Packing for ecommerce (small parcel, bubble mailer, box) or wholesale (carton, pallet). Award classification typically Level 1 or Level 2 Storage Services.
Receival and dispatch
Container and trailer unload, pallet check in, put-away, outbound loading, paperwork reconciliation. Often the first warehouse role where forklift exposure begins. Level 2 to Level 3 Storage Services classification depending on experience.
Forklift operators
Three HRWL licence classes apply. Each has a different use case and rate.
- LF counterbalance forklift. The standard warehouse forklift. Carries a rated load on forks with a counterweight at the rear. Most common licence class.
- LO order picker. Operator-up high-reach truck used to pick stock at height from racking. Generally higher rates than LF because of the skill and safety profile.
- LT (forklift truck). No longer issued since 2014 as a standalone class, but grandfathered licences remain valid. For new operators, LF or LO applies.
Licence verification through WorkSafe’s national HRWL portal is mandatory. The physical card on its own is not enough.
Stock control and inventory
Cycle counting, stocktake, WMS input, discrepancy investigation. Level 3 Storage Services classification and above.
Cold chain
Work under 5 degrees Celsius (coolroom) or under minus 18 degrees Celsius (freezer). Specific PPE, shorter shift rotations, and a wage premium usually apply. Pool size is smaller, so lead time can be longer.
What to expect in week one?
- Day 1: Worker arrives with photo ID, visa documentation, HRWL card if licensed, and approved PPE. Host delivers a site-specific induction and WHS orientation.
- Day 2 to 3: Worker is supervised through the shift. Minor pace or accuracy issues are normal and coachable.
- Day 4 to 5: Pace and quality should approach steady state. The Wise Recruitment account manager checks in via phone or site visit.
- End of week 1: Timesheet approval, feedback loop, and any adjustments (shift pattern, role fit, additional workers).

Once the first week is behind you, the engagement moves from setup to steady state. Timesheets run on a weekly or fortnightly cycle, approved by a nominated supervisor at the host site. The agency handles the worker’s pay, super, and tax remittance. Invoices land on the same cycle and should carry a clear line-item breakdown by worker, hours, rate, and any shift loadings. No-shows and medical absences are back-filled the same day where the pool allows. Any performance concern is raised through the account manager rather than directly with the worker, so there is a consistent record. Pool retention at 30 days is the single best signal of a healthy placement: anything below 80 per cent is worth reviewing with the provider. Sites that run labour hire well treat the agency like a supplier partnership, not a transaction: briefing upcoming volume, sharing peak forecasts, and flagging site changes early. That is where the real cost savings sit, not in negotiating the hourly rate.
